By accessing and using CalorieNaija ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

CalorieNaija is a digital health food diary application that provides nutritional information for Nigerian and African foods. The Service includes meal logging, calorie tracking, nutritional analysis, and wellness support features.

CalorieNaija is operated by Felly Medical Aesthetics Ltd, a company registered in the United Kingdom.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Subscription and Payment

CalorieNaija offers both free and paid subscription plans. Paid subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless cancelled before the renewal date.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing period.

5. User Content

You retain ownership of any content you submit to the Service, including meal logs, photos, and personal health information. By submitting content, you grant CalorieNaija a licence to use, store, and process this content solely for the purpose of providing the Service to you.

You are responsible for the accuracy of the information you provide. CalorieNaija is not responsible for any consequences resulting from inaccurate or incomplete user-provided information.

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, offensive, or illegal content
• Attempt to gain unauthorised access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without our express written consent

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Felly Medical Aesthetics Ltd and is protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

8. Disclaimer of Warranties

CalorieNaija does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FELLY MEDICAL AESTHETICS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Felly Medical Aesthetics Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
